1.Information Inspired Collects
Your privacy is important to us. The websites, applications, widgets, and scripts, together with any services, software, or materials provided by Inspired Member, Inc. (“Inspired”, “we”, “us” and “our”) through or in connection with any of the foregoing, are collectively referred to as the “Platform.” The Platform may be provided via Shopify, in the form of the Inspired Shopify App, or another third-party platform. This Privacy Policy addresses the collection, use, and disclosure of information that Inspired may gather during your use of the Platform.
Please review this entire Privacy Policy to learn the types of information that Inspired gathers, how Inspired uses that information, what information is disclosed and to what third parties, and how Inspired safeguards your information.
Please also check back periodically as this Privacy Policy may change from time to time. We will notify you of any material changes by publishing the new Privacy Policy through the Platform. The information Inspired gathers is and will be subject to the Privacy Policy in effect at the time the information is gathered. Should you have any questions or concerns at any time, please feel free to contact us.
This Privacy Policy applies only to the Platform. This Privacy Policy does not apply to any websites and/or applications managed, maintained, and/or hosted by third parties not directly affiliated with Inspired that you may access, use, or visit, e.g., via a link provided through the Platform or on a website and/or application maintained by any third party. Inspired does not control the privacy policies of other websites and/or applications to which we may provide hyperlinks. We encourage you to learn more about the online privacy and data security policies of third party websites and/or applications directly from such third parties, as their policies may differ from ours.
PLEASE REVIEW THIS PRIVACY POLICY. BY USING THE PLATFORM AND/OR BY SUBMITTING YOUR INFORMATION TO US, INSPIRED WILL ASSUME THAT YOU HAVE READ, UNDERSTOOD, AND CONSENT TO THE AGREEMENT, WHICH INCLUDES THIS PRIVACY POLICY, AND ALL OTHER APPLICABLE INSPIRED RULES AND POLICIES. WE ALSO ASSUME THAT YOU CONSENT TO INSPIRED’S USE OF YOUR INFORMATION AS DESCRIBED IN THE AGREEMENT. IF YOU DO NOT CONSENT, YOU SHOULD NOT ACCESS OR USE THE PLATFORM.
1.1 Information Collected Through The Platform Directly
We may process Personal Information about you that you provide voluntarily when you visit our Platform directly., This includes information provided by a Brand Partner (for example, when a Brand Partner installs the Inspired Shopify App), an Integration Partner (for example, when Inspired is enabled through an integrated service), or an Individual User (for example, when directed to the Platform from a Brand Partner Store or Integration Partner service and creating an Inspired account). This information may include your name, phone number, email address, postal addresses, and other information that could be used to personally identify you.
1.2 Information Collected From Individuals Who Visit Brand Partner Stores or Integration Partner Services
Personal Information is provided to us by our Brand Partners (e.g., via Shopify webhooks when a qualified purchase is made on a brand site or other business integrations) in order to enable donation gift functionality. We may also collect information from Integration Partners who integrate Inspired into their services in a manner similar to Brand Partners. This information may include (a) Personal Information (name, phone number, email and address), (b) non-identifying Information (zip code, gender, age, and individual preferences); (c) usage data (information sent automatically by a browser when visiting a Brand Partner Store, Integration Partner service, or the Platform — such as browser type, operating system, referring/exit pages, pages visited, time spent on pages, search terms, access times and dates, and geolocation data), and (d) transaction data (information relating to transactions with individuals who visit Brand Partner Stores, Integration Partner services and/or our Platform, including purchase information, dates of purchase and purchase history).
Once an individual takes action within the Inspired Platform (such as redeeming a donation gift, selecting a cause, or creating an account), Inspired also collects personal information directly from that individual as part of our program.
1.3 Non-Identifying Information
We also collect other information that you provide as part of registration and the administration and personalization of your account with us that does not identify you (“Non-Identifying Information”). Non-Identifying Information includes, but is not limited to, your zip code (on its own), gender, age, and individual preferences. Certain Non-Identifying Information may be considered a part of your Personal Information if it were combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be identified. This information may also include transaction details, such as organizations which you designate for receiving contributions through the Platform, and dates and history of such designations.
Inspired does not collect Sensitive Personal Information (such as financial account numbers, health data, SSNs, precise geolocation, etc.) as defined under U.S. state privacy laws, except where required by law or expressly provided by the user.
1.4 Usage Data
When you visit the Platform, whether you are logged in or just browsing without logging in, our servers automatically record information that your browser sends whenever you visit a website and/or application. The information sent automatically by your browser is referred to as “Usage Data.” This Usage Data may include information such as the manufacturer and model of your mobile device, your Internet Service Provider (ISP); your device’s Internet Protocol (“IP”) address (or other device identifier), browser type, and operating system; referring/exit pages; clickstream data; pages of the Platform that you visit, the time spent on those pages or interacting with certain portions of the Platform, information you search for on the Platform, access times and dates; and other statistics.
Usage Data also includes geolocation data. The Platform will use geolocation data only with respect to providing and improving the Platform and will not transfer this data to third parties other than in connection with their providing services to Inspired. The Platform will request your express permission to collect your geolocation data.
We use this information for technical administration of the Platform, including to monitor and analyze use of the Platform, to increase the functionality and user-friendliness of the Platform, and to better tailor the Platform to Users’ needs. Additional detail on how we may use Usage Data is provided below in Section 3.
Usage Data may be non-identifying or it may be associated with you. Whenever we associate Usage Data with Personal Information, we will treat it as Personal Information.
2.Collection of Information
2.1 Generally
We may share aggregated, de-identified User information with advertisers and other third parties for various purposes, including (i) in order to promote or describe use of the Platform (ii) compliance with various reporting obligations; (iii) for business or marketing purposes; and (iv) to assist such parties in understanding our Users’ interests, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and/or functionality available through the Platform. In addition, we may aggregate and use operational performance data and usage trends of the Platform for business and marketing purposes in order to publicly demonstrate the benefits of our offerings through the Platform in any and all use scenarios.
2.2 Collection of Information – Specific Methods, Formats and Technologies
Inspired collects Personal Information and Non-Identifying Information (together, “User Information”) in various ways. For individuals, this may include:
Information provided by Brand Partners when an individual visits a Brand Partner Store (including purchases of products and services).
Information provided by Integration Partners when an individual interacts with an integrated service that includes Inspired functionality.
Information the individual provides directly when using the Platform, visiting Inspired’s website or apps, registering for an account, verifying identity, posting content on the Platform, or submitting customer service-related requests.
This information may also include transaction details, such as organizations designated to receive contributions through the Platform, along with dates and history of such designations.
For Brand Partners and Integration Partners, Inspired may collect Personal Information provided through Shopify or other integration methods when installing the Inspired app, using the Platform, registering accounts, verifying identity, posting content, or submitting service-related requests.
3.Use of Information by Inspired
We may also use a number of different methods, formats and technologies to collect User Information and Usage Data, including via the use of the following:
(a) Forms
We request certain information from you through the use of forms when you create an account with us. For example, when creating a user account, we may ask you to enter your first and last name, e-mail address(es), mailing address and phone number.
(b) Surveys, Polls, Questionnaires
We may request certain information from you through the use of surveys, polls, and questionnaires when you sign up for certain features of the Platform. For example, we may ask you to enter information like what causes are close to your heart, physical mailing address, and other information, so that the feature you are signing up for can be better tailored to you. Some or all of this information will be optional for you to provide.
(c) Cookies
As is regular practice on many websites and applications, the Platform uses cookies and other technologies to help us understand which parts of the Platform are more popular and how much time Users spend there. A cookie is a small amount of data that is sent to and stored on your device from our server. Cookies may, for example, allow a user to enter a password less frequently or remember a user’s preferences during an online session.
The Platform uses cookies to determine whether a User is active and for other business purposes. The Platform may include first-party cookies (i.e., cookies that send data directly to us and our agents and contractors, including cookies used to monitor, analyze, and administer the Platform) and third-party cookies (i.e., cookies that send data to our contractors for their commercial use). The cookies on our Platform are used for authentication, security, analytics, and functionality. We do not use cookies for third-party cross-context behavioral advertising. Since cookies are now used as industry standard, most devices automatically accept cookies, but you can usually change your device’s settings to decline them. If you prefer not to enable cookies, you may choose to disable them; however, please note that certain features on the Platform may not be available to you once cookies are disabled.
(d) Usage Data Collected via Automatic Means
Usage Data is collected automatically by the Platform’s servers and software. For example, because the Platform automatically collects Usage Data for all Users that visit the Platform, your Platform session will be tracked. You agree that we may collect and use technical data and related information, including technical information about your device, system and application software, to facilitate the provision of software updates, product support and other services to you related to your use of the Platform.
Additionally, in some of our website content and email messages, we may use a “click-through URL” linked to content on the Platform. When a User clicks onto one of these URLs, the User will pass through our server before arriving at the destination Web page. We track this click-through data to help us determine User interest in certain subject matter and measure the effectiveness of content and communications. You can avoid being tracked in this way by not clicking text or graphic links on in website content or emails from us.
Finally, we may use clear gifs or pixel tags, which are tiny graphic images, in order: (i) to advise us of what parts of the Platform Users have visited, (ii) to measure the effectiveness of any searches Users perform, and (iii) to enable us to send emails in a format that Users can read and tell us whether such emails have been opened in order to ensure us that we are sending messages that are of interest to Users.
(e) Tracking
Because Inspired does not sell or share personal information as defined by U.S. state laws, the Platform does not recognize or respond to browser-based opt-out signals such as Global Privacy Control (GPC).
(f) Public Communications
Please note that if you use any bulletin board, chat room, comment posting feature, or other public communication service, forum, or feature offered through the Platform, or post any information available for viewing by other Users, which may include any Personal Information that you disclose, any of the information that you share will be visible to other Users. The information that you make available can be read, used, and collected by other Clients and Users to send you unsolicited messages outside of the Platform. While all Clients must adhere to our Terms of Use which include restrictions on Users’ use of the Platform, we are not responsible for the manner in which the Personal Information that you decide to share will be used by other Users.
4.Sharing of Information by Inspired
We may use User Information that we collect for the following purposes:
(a) To operate, maintain, enhance and provide all features of the Platform, to provide services and information that you request, and to respond to comments and questions and otherwise to provide support to Clients and Users.
(b) To understand and analyze the usage trends, operational performance and preferences of our Users, to improve the Platform, and to develop new products, services, features, and functionality, to more effectively communicate the benefits of Inspired offerings and to provide you additional services and functionality.
(c) To contact you for administrative purposes such as donation redemption confirmations, customer service, right of privacy violations; or to send communications, including updates on promotions, offers and events, relating to products and services offered by us and by third parties we work with. Generally, you have the ability to opt-out of receiving any promotional communications as described below under “Inspired’s Opt-Out Policy.”
(d) We may use “cookies” information and Usage Data to: (i) personalize our services, such as remembering your information so that you will not have to re-enter it during your visit or the next time you visit the Platform; (ii) provide you with customized advertisements, content, and information; (iii) monitor and analyze the effectiveness of sections of the Platform and third-party marketing activities; (iv) monitor aggregate site and/or app usage metrics; and (v) track your entries, submissions, and status in any promotions or other activities on the Platform.
(e) To add to our databases and use for business purposes, including for marketing and promotional purposes, for a statistical analysis of Users’ behavior, for product development, for content improvement, or to customize the content and layout of the Platform.
We may also combine your de-identified and aggregated Personal Information with Non-Identifying Information and aggregate it with information collected from other Users in order to provide you with a better experience, to improve the quality and value of the Platform, and to analyze and understand how the Platform is used.
4.1 Other Business Partners and Vendors
Inspired may share User Information with Brand Partners, Integration Partners, and Service Providers as described in Section 4.2. Service Providers are contractually required to protect User Information and may only use it to perform services on Inspired’s behalf.
4.2 Promotions
We may share User Information only as necessary to operate and support the Platform. This includes:
Brand Partners and Integration Partners. User Information may be provided back to the Brand Partner or Integration Partner from which it originated, but only to enable Platform functionality or fulfill features selected through the Platform. Inspired does not provide Brand Partners or Integration Partners with new personal information they did not already collect in the first instance.
Service Providers. User Information may be shared with Service Providers engaged by Inspired to perform functions on Inspired’s behalf, such as hosting, analytics, or customer support. Service Providers are provided only the information reasonably necessary to perform their functions and are contractually required to maintain the confidentiality and security of such information.
Charity Partners. User Information is shared with Charity Partners solely when an individual has expressly opted in to receive communications from that Charity Partner. In such cases, Inspired may provide the Charity Partner with the individual’s email address and other information authorized for that purpose.
Inspired does not sell personal information and does not share it with third parties for cross-context behavioral advertising.
Generally, we limit the information provided to these service providers to that which is reasonably necessary for them to perform their functions, and we require them to agree to maintain the confidentiality of such information.
4.3 Business Transfers
From time to time, we may offer promotions through the Platform that require a separate registration. By participating in such a promotion, you agree to the official rules for the promotion, which may require that you provide certain information. Information collected in connection with a promotion will be used consistently with the promotion’s official rules and this Privacy Policy.
4.4 Compliance with Law and Protection of Inspired and Others
As we continue to develop our business, we may buy, sell, or share assets in connection with, for example, a merger, acquisition, reorganization, sale of assets, bankruptcy, or other similar transaction. In such transactions, information about Users generally is often a transferred business asset. In the event that Inspired itself or substantially all of Inspired’s assets are acquired, information about our Users may be one of the transferred assets.
4.5 Aggregate Site Use Information
We may disclose your information if required to do so by law or if we have a good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. copyright law), in response to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement or other governmental agencies.
We also reserve the right to disclose your information that we believe, in good faith, is appropriate or necessary to (i) to enforce or apply the Agreement, including this Privacy Policy the User Agreement, and other any Inspired agreements, rules, and policies (ii) take precautions against liability, (iii) protect ourselves or others from fraudulent, abusive, or unlawful uses or activity, (iv) investigate and defend ourselves against any third-party claims or allegations, (v) protect the security or integrity of the Platform and any facilities or equipment used to make the Platform available, or (vi) protect our property or other legal rights, or the rights, property, or safety of others.
5.Inspired’s Opt-out Policy
We encourage you to periodically review our Privacy Policy to be sure you are familiar with the most current version.
We may update our Privacy Policy from time to time. We will make reasonable efforts to notify our Users when we make any significant changes to our Privacy Policy that affect the use of any Personal Information we collect. For example, we may send a message to your email address, if we have one on file, or generate a pop-up or similar notification when you access the Platform for the first time after such material changes are made. Your continued use of the Platform after the revised Privacy Policy has been posted throughout the Platform indicates that you have read, understood and agreed to the current version of the Privacy Policy.
We will not make new use of any User information which Inspired gathered from individual Users prior to any such significant change in our Privacy Policy without first obtaining the User’s consent for any new uses.
Opt-Out Policy and Privacy Rights Requests:
Partner-provided data. If your personal information was originally provided to Inspired by a Brand Partner (for example, through a purchase on a brand site), or an Integration Partner, please direct your request to that Brand Partner or Integration Partner. Inspired will support them in fulfilling such requests.
Direct interactions with Inspired. If you engaged directly with Inspired (such as by redeeming a donation gift, selecting a cause, or creating an Inspired account), you may exercise your privacy rights with us. You can do so by:

Your rights under U.S. state law. California residents and residents of certain other states have the right to opt out of the sale or sharing of personal information. Inspired does not sell personal information, and we only share email addresses with Charity Partners when an individual has expressly opted in. Nevertheless, you may use the options above to submit an opt-out request.
Marketing vs. transactional emails. If you opt out of marketing communications, you will still receive transactional or service-related communications (such as donation redemption confirmations or account notices).
6. Changing or Deleting Your Information
You may, of course, decline to share certain Personal Information with us, in which case we may not be able to provide to you some of the features and functionality of the Platform. By using the Platform, you agree that Inspired may contact you in the event of a change in the Agreement, including this Privacy Policy, to provide you with any service related notices, or to provide you with information about Inspired events, invitations, or related educational information.
We currently provide the following “Opt-Out Opportunities”:
(a) At any time, you can follow a link provided in offers, newsletters or other email messages (except for transactional emails such as e-commerce confirmation, donation redemption confirmation or service notice emails) received from Inspired to unsubscribe from receiving such messages.
(b) At any time, you can contact us through help@inspired.com or the address or telephone number provided below to unsubscribe from receiving such messages and to opt-out of our right per your consent under the terms of this Privacy Policy to share your Personal Information.
We may also allow you to view and modify settings relating to the nature and frequency of promotional communications that you receive from us in the User account functionality on the Platform.
Please note that even if you opt out of marketing communications, you will continue to receive transactional or service-related communications (such as donation redemption confirmations or account notices).
7. Third Party Service Providers, Links to other Sites, and Third Party Advertising
This Privacy Policy applies only to the Platform. This Privacy Policy does not apply to any websites and/or applications managed, maintained, and/or hosted by third parties not directly affiliated with Inspired that you may access, use, or visit, e.g., via a link provided through the Platform or on a website and/or application maintained by any third party. Inspired does not control the privacy policies of other websites and/or applications to which we may provide hyperlinks, including but not limited to our third party service providers. We cannot be responsible for the privacy practices or the content of such non-Inspired websites and/or applications, and we do not control the practices of any of the third party websites and/or applications or service providers to whose sites and/or apps we link. We encourage you to learn more about the online privacy and data security policies of third party websites and/or applications directly from such third parties, as their policies may differ from ours.
8. Social Media Sites
Inspired operates and maintains social media networking pages on websites and/or applications such as Facebook, Twitter, Instagram and LinkedIn. Inspired will, from time to time, import comments and posts from these third-party websites and/or applications to the Platform. If you post to any of Inspired’s social networking pages on third-party websites and/or applications, you are providing information to the public and do so at your own risk. Further, Inspired may use these postings on its Platform without notice or compensation to you. Please visit the privacy policies of any third party websites and/or applications before posting to Inspired’s pages there. We are not responsible for information you voluntarily post on social media.
9. International Transfer
The Platform is controlled and operated from the United States and is intended for use by U.S. residents. If you access the Platform from outside the United States, your information will be transferred to and processed in the United States under U.S. law.
10. Data Security and Retention
We implement robust security measures to protect user data from unauthorized access, disclosure, alteration, and destruction. Our security measures include encryption, firewalls, access controls, and regular security audits. We also restrict access to client data to authorized personnel only, who are trained in handling personal information appropriately.
We retain merchant-provided data only as long as necessary to provide services on behalf of the Brand Partner, after which it is securely deleted or anonymized. For data collected directly from individuals engaging with Inspired (e.g., donation redemptions, cause selections, opt-ins), we retain it as long as necessary to administer our program or comply with law.
Please note that no security system is impenetrable. Accordingly, we do not guarantee the security of our databases, nor that information you supply won’t be intercepted while being transmitted to us over the Internet or other network. Further, even after information posted on the Platform is removed, caching and archiving services may have saved that information, and other users or third parties may have copied or stored the information available on the Platform. We cannot and do not guarantee that information you post on or transmit to the Platform will not be viewed by unauthorized persons. Any information you transmit to Inspired, you do at your own risk.
We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored “personal data” (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting through the Platform in the most expedient time possible and without unreasonable delay, as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.I
n the event of a data breach involving personal information, Inspired will provide notice in accordance with applicable U.S. state data breach notification laws.
11. Children’s Privacy
Protecting the privacy of young children is especially important. The Platform is not directed to children under the age of thirteen (13), and we do not knowingly collect Personal Information from children under the age of thirteen (13) without obtaining parental consent. Under the terms of the Agreement, Users must be at least thirteen (13) years of age to access and use the Platform. Any access to or use of the Platform by anyone under the age of thirteen (13) is unauthorized, unlicensed, and in violation of the Agreement. By using the Platform, you represent and warrant that you are thirteen (13) years of age or older and that you agree to and agree to abide by all of the terms and conditions of the Agreement. If Inspired believes that you are under the age of thirteen (13) or that you are not old enough to consent to and be legally bound by the Agreement, Inspired may, at any time, in its sole discretion, and with or without notice: (i) terminate your access to or use of the Platform (or any portion, aspect, or feature of them), or (ii) delete any content or information that you have posted through the Platform. If you are a parent or guardian and discover that your child under thirteen (13) years of age has obtained an account on the Platform, then you may alert us at help@inspired.com and request that we delete that child’s Personal Information from our systems.
If you are between thirteen (13) and sixteen (16) years old and reside in California or another state with similar laws, we will not sell or share your personal information without your affirmative opt-in consent.
12. Your U.S. Privacy Rights
Depending on where you live, (for example, California, Colorado, Connecticut, Utah, Virginia, Texas, and other states with similar laws), you may have the following rights under state privacy laws.
Merchant-provided data. If your personal information was originally provided to Inspired by a Brand Partner (for example, through a purchase on a brand site), please direct your request to that Brand Partner. Inspired will support our Brand Partners in fulfilling such requests.
Direct interactions with Inspired. If you engaged directly with Inspired (such as by redeeming a donation gift, selecting a cause, or creating an Inspired account), you may exercise your privacy rights directly with us using the methods described below.
Right to Know/Access – request details about the categories and specific pieces of personal information we collect, the sources, purposes, and with whom it is disclosed.
Right to Know/Access and Portability – request details about the categories and specific pieces of personal information we collect, the sources, purposes, and with whom it is disclosed. We will provide this information in a readily usable, portable format where required by law.
Right to Delete – request deletion of personal information, subject to legal or business exceptions.
Right to Correct – request correction of inaccurate personal information.
Right to Opt-Out of Sale/Sharing – opt-out of the sale or sharing of personal information for cross-context behavioral advertising. Inspired does not sell personal information for money. We do not share customer email addresses with Brand Partners, and we only share a customer’s email address with a Charity Partner if the customer has expressly opted in.
Right to Limit Use of Sensitive Personal Information – if we collect sensitive personal information, you may direct us to limit its use to necessary purposes allowed by law.
Right to Non-Discrimination – we will not deny you goods/services or provide a different level of service because you exercised your privacy rights.
How to Exercise Your Rights. If your personal information was provided to Inspired by a Brand Partner (for example, via a Shopify webhook when a qualified purchase is made on a brand site), please contact that Brand Partner directly to exercise your privacy rights. Inspired will support our Brand Partners in fulfilling such requests. If you interact directly with Inspired (such as redeeming a donation gift, selecting a cause, or creating an account), you may exercise your rights directly with us by emailing help@inspired.com or by writing to us at P.O. Box 31, Manhattan Beach, CA 90267.
13. California Privacy Rights for Minors
To the extent required by applicable law, if you are a registered user of the Platform and are under 18 years of age, you may request and obtain removal of content or information you have posted on the Platform. In some cases, the Platform will enable you to remove such content or information yourself. Otherwise, you may request such removal by emailing us at help@inspired.com with a clear statement describing the content or information you would like removed and its location on the Platform. The requested removal does not ensure complete or comprehensive removal of such content or information. In some cases, removal is subject to and limited by the provisions of applicable law (for example, content or information might not be removed if it was reposted by a third party, or if it has been anonymized so that you cannot be individually identified, or if it is rendered invisible to other users and the public.)
14. California Privacy Rights
Under California Civil Code sections 1798.83-1798.84, California residents are entitled to ask us for a notice describing what categories of personal customer information we share with third-parties or corporate affiliates for those third-parties or corporate affiliates’ direct marketing purposes. That notice will identify the categories of information shared and will include a list of the third parties and affiliates with which it was shared, along with their names and addresses. If you are a California resident and would like a copy of this notice, please submit a written request to help@inspired.com.
15. Changes to this Privacy Policy
If you wish to access or amend any other Personal Information about you that we collect, or to request that we delete any Personal Information about you that we collect , please contact us with a request at help@inspired.com. We will make every reasonable effort to ensure that any changes you make will be reflected in active user databases as promptly as possible. However, please note that we may retain your information to the extent the information is archived on back-up systems, and for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate business reason to do so.
